'With final approval, Teva could theoretically launch its generic Lexapro in the U.S. market -- an `at-risk` launch -- meaning that if it is found to infringe the (Forest) Lexapro patent, Teva could be liable for treble damages,' Ntantoulis stated in a research report. 'We expect that with a decision in the litigation so close at hand (expected June/July), the company will wait for the court decision,' he added. He also noted that Teva and Forest agreed in January that if Teva did launch prior to a decision in the patent suit, Teva would give Forest 45 days notice.
